Filing for Divorce in Wisconsin > Step 5: Negotiate a Settlement

Once all financial information has been exchanged, we can move on to negotiating a final divorce settlement.

Negotiations typically take one of two forms

1. Informal Offer and Counter-Offer

When the issues are not overly complex, a Wisconsin divorce settlement can often be reached by a back-and-forth negotiation over phone or email, with the lawyer or lawyers exchanging drafts of settlement agreements.

Back-and-forth negotiations like this can get costly when the issues are numerous or complex. In that case, a settlement conference may be necessary.

2. Settlement Conferences

A settlement conference is a meeting between the spouses and their lawyer(s) at the office of one of the Wisconsin divorce attorneys. The purpose of a settlement conference is to allow extended time for the divorcing parties and their attorneys to negotiate a compromise agreement. Our lawyers successfully resolve more than 80 percent of cases at a final settlement conference.

A final negotiated agreement results in the formation of a document called a Marital Settlement Agreement, which outlines all of the various agreements made by the divorcing spouses.

Once finalized and signed by the divorcing parties, the Marital Settlement Agreement is sent to the judge for approval. If the judge assigned to the divorce approves of terms and conditions presented in the Marital Settlement Agreement, a divorce will be granted.

Our attorneys have successfully negotiated thousands of divorce cases to full resolution.

Once you and your spouse have negotiated a divorce settlement, the next step in the divorce process is dispute resolution.
