Are gifts received between the parties exempt from the marital estate?
The answer is no. Gifts exchanged during the marriage between the parties are still considered part of the marital estate. Sec. 767.61 of the Wisconsin Statutes, PROPERTY DIVISION (2) 1., specifically makes clear that gifts from third parties are not part of the marital estate, but gifts between the parties are included as part of the marital estate.
